1.1. These Terms of Sale apply to the purchase of goods and services between the buyer of the online store www.meditsiinigrupp.ee\/pood and the company Meditsiinigrupp AS (hereinafter referred to as Meditsiinigrupp).<\/p>\n\n
1.2. In addition to these terms, the legal relations arising from the purchase of products from Meditsiinigrupp’s online store are governed by the Law of Obligations Act (hereinafter LOA), the Consumer Protection Act (hereinafter CPA), and other legal acts valid in the Republic of Estonia.<\/p>\n\n
1.3. Meditsiinigrupp reserves the right to amend these Terms of Sale. Such amendments will be published on the website www.meditsiinigrupp.ee\/pood\/muugitingimused\/. <\/p>\n\n
1.4. The product images in the online store are illustrative and may differ from the actual products.<\/p>\n\n
1.5. Unintentional errors may occur in the descriptions of products in the online store. We recommend checking the information on the manufacturers’ websites. <\/p>\n\n
1.6. Meditsiinigrupp has the right to withdraw from a sales contract concluded via the e-shop without sanctions and not deliver the ordered goods or provide the service in the following cases:
If Meditsiinigrupp is unable to fulfill the order, Meditsiinigrupp will contact the buyer and refund the paid amount if the buyer has made an advance payment for the goods.<\/p>\n\n
2.1. All prices displayed in the Meditsiinigrupp online store are in euros (EUR) and include VAT.<\/p>\n\n
2.2. Shipping costs will be added to the price according to the delivery method chosen by the buyer.<\/p>\n\n
2.3. Prices are valid from the moment the order is placed until the payment deadline for the placed order expires (1 day after placing the order).<\/p>\n\n
3.1. Add the desired product to the shopping cart.<\/p>\n\n
3.2. To view the contents of your shopping cart, select “Shopping Cart” from the top right corner of the website.<\/p>\n\n
3.3. To place an order, fill in the required data fields with your information.<\/p>\n\n
3.4. Choose your preferred product delivery method.<\/p>\n\n
3.5. After entering the necessary information to place your order, select your preferred payment method. Payments are processed outside the e-shop environment in the secure payment environment of the customer’s bank or payment service provider. <\/p>\n\n
In our e-shop, you can pay via bank links from Estonian, Finnish, Latvian, and Lithuanian banks, with Visa and MasterCard payment cards, and through Google Pay and Apple Pay solutions. Payment by invoice is also available. Additionally, we offer the option to use Inbank hire purchase or pay in up to three installments with no extra fees. <\/p>\n\n
3.6 To confirm your order, check the box “I have read and agree to the online store’s terms and conditions” and then select “Place order”.<\/p>\n\n
3.7. Orders placed in the online store are processed on weekdays, Monday-Friday, from 9:00 AM to 3:00 PM. If an order is placed on Friday after 2:00 PM, it will be processed on the following Monday. <\/p>\n\n
4.1. With the sales contract for goods, Meditsiinigrupp undertakes to transfer to the buyer existing, manufactured, or future goods acquired by Meditsiinigrupp and to enable the transfer of ownership to the buyer, while the buyer undertakes to pay Meditsiinigrupp the amount indicated on the invoice for the goods and to accept the goods.<\/p>\n\n
4.2. Orders that have not been paid for will be cancelled after 7 days from the date of placing the order.<\/p>\n\n
4.3. The sales contract enters into force after the buyer’s payment has been received in Meditsiinigrupp’s bank account.<\/p>\n\n
5.1. After the sales contract enters into force, the ordered goods can be received according to the chosen delivery method:<\/p>\n\n
5.1.1. The courier company will deliver the goods to the address specified in the order;<\/p>\n\n
5.1.2. The goods will be sent to the parcel locker specified in the order;<\/p>\n\n
5.2. The delivery times indicated on the e-shop website are valid from the moment the order amount is received in the e-shop’s bank account.<\/p>\n\n
5.3. For delivery without delay, care must be taken and accurate and valid delivery information must be provided when placing the order.<\/p>\n\n
5.4. Meditsiinigrupp is not responsible for delays in the delivery of goods if the goods were handed over to logistics partners on time, but the delay in delivery is due to circumstances that Meditsiinigrupp could not influence or foresee.<\/p>\n\n
6.1. The consumer has the right to withdraw from the contract concluded in the online store without giving a reason within 14 days of receiving the goods. The statutory 14-day right of withdrawal does not apply to legal entities. <\/p>\n\n
6.2. The returned product must be unopened and complete (including product packaging and all items contained within the product packaging, etc.). If the product was purchased as part of a campaign where another product was added to the item, you must return the entire set (i.e., all products). <\/p>\n\n
6.3. In the event of deterioration of the returned goods, the buyer is responsible for the decrease in value resulting from the use of the item. To ascertain the nature, characteristics, and functioning of the goods, the buyer should only handle and use the item as they would normally be allowed to do in a store.<\/p>\n\n
6.4. Goods that are not suitable for return for health protection or hygiene reasons and if they have been opened after delivery cannot be returned.<\/p>\n\n
6.5. You can submit a withdrawal application via the application form<\/a> in the online store or send it in free form by e-mail to <\/a>pood@meditsiinigrupp.ee<\/a> no later than 14 days after receiving the goods. <\/p>\n\n 6.6. The buyer must return the goods within 14 days following the submission of the application or provide proof that they have handed over the goods to a logistics company within the aforementioned period.<\/p>\n\n 6.7. Meditsiinigrupp has the right to refuse to make refunds until the seller has received the goods that are the subject of the contract back or the buyer has provided evidence that they have sent the goods back, whichever occurs earlier.<\/p>\n\n 6.7. Upon withdrawal from the contract, AS Meditsiinigrupp shall return to the buyer all payments received under the contract, including delivery costs (except for additional costs resulting from the delivery method chosen by the buyer, which differs from the cheapest standard delivery method offered by AS Meditsiinigrupp) without delay, but no later than 14 days from the day the seller becomes aware of the buyer’s decision to withdraw from the contract.<\/p>\n\n 6.8. All direct costs of returning the goods shall be borne by the buyer.<\/p>\n\n 6.9. The buyer has the right to cancel their order after paying for the goods but before the delivery of the goods without additional costs by sending a corresponding e-mail to <\/a>pood@meditsiinigrupp.ee<\/a>. A confirmation of the cancellation of the contract will be sent to the buyer. <\/p>\n\n 7.1. Meditsiinigrupp is not responsible for damages caused to the Customer or delays in the delivery of goods if the damage or delay in delivery is due to circumstances that Meditsiinigrupp could not influence or foresee.<\/p>\n\n 8.1. By entering data in the online store and providing the corresponding confirmation, the buyer grants the right to collect and process the buyer’s personal data (name, contact phone, parcel delivery and\/or home address, email address) and to transfer personal data to logistics partners for the delivery of goods.<\/p>\n\n 8.2. Meditsiinigrupp has the right to use the buyer’s contact details for sending advertisements and other information to the buyer.<\/p>\n\n 8.3. The buyer has the right at any time to prohibit the collection and use of their personal data, except when it is necessary for enforcing a claim arising from the contract or for the delivery of goods.<\/p>\n\n 8.4. Encrypted data communication with banks when paying for purchases ensures the security of the buyer’s personal banking credentials, and the online store also has no access to them.<\/p>\n\n 9.1. Meditsiinigrupp is responsible for non-conformity or defects of goods sold to the buyer that appear within two years from the date of delivery of the goods to the buyer. For legal entities, we provide a 3-month period for submitting complaints. <\/p>\n\n 9.2. In the event of a defect, the buyer has the right to contact Meditsiinigrupp within two months, by presenting the invoice used for the purchase of the goods. Notification of non-conforming goods must be sent to Meditsiinigrupp’s email address pood@meditsiinigrupp.ee<\/a> or by calling +372 6140 801. Should the buyer fail to notify Meditsiinigrupp of the non-conformity of the goods within the period specified in this clause, Meditsiinigrupp shall be released from liability for the non-conformity of the goods. <\/p>\n\n 9.3. In the event of a defect in the goods, please cease using the goods.<\/p>\n\n 9.4. Meditsiinigrupp is responsible for non-conformity and defects of the goods that appear within 2 years from the date of delivery of the goods to the user, as follows:<\/p>\n\n \u2013 within the first six months from the moment of delivery of the goods, it is presumed that the non-conformity of the goods already existed at the time of delivery, i.e., the burden of proof for the conformity of the goods’ quality lies with Meditsiinigrupp.<\/p>\n\n \u2013 after six months from the moment of delivery of the goods, the burden of proof for the non-conformity of the goods’ quality lies with the buyer.<\/p>\n\n 9.5. Meditsiinigrupp and the buyer shall agree on the repair or replacement of defective goods.<\/p>\n\n 9.6. Meditsiinigrupp is not responsible for defects in the goods caused by the buyer’s fault, which have arisen as a result of improper storage or use of the goods.<\/p>\n\n 9.7. In the event of non-conformity or defects in the goods, please submit a claim to pood@meditsiinigrupp.ee, stating the name of the orderer, contact phone number, order number, and a precise description of the non-conformity or defect of the goods.<\/p>\n\n 9.8. A complaint regarding the discovery of non-conformity or a defect in the goods must be submitted within two months from the discovery of the non-conformity or defect.<\/p>\n\n 9.9. All complaints will be reviewed, and the buyer will be contacted as soon as possible, but no later than within 14 days from the receipt of the complaint.<\/p>\n\n 9.10. The buyer has the right to demand from Meditsiinigrupp a reduction in the purchase price or termination of the contract and a refund for the goods if Meditsiinigrupp is unable to repair or replace the goods, or if the repair or replacement of the goods fails.<\/p>\n\n 10.1. If Meditsiinigrupp has refused to resolve the buyer’s complaint or the buyer is not satisfied with the solution offered by Meditsiinigrupp and believes that their rights have been violated or interests harmed, the buyer may submit a complaint to the Consumer Disputes Committee through the Consumer Protection and Technical Regulatory Authority. The buyer may submit a complaint themselves or through a representative.
